Question 2 – When Can I Buy Weed in Nevada

UPDATE (4/12/2017): There are several plans in motion that would allow recreational sales to begin in Nevada on July 1, 2017. However, some cities and counties are toying with their own regulations, so continue to watch here for updates.

The Regulation and Taxation of Marijuana Act, better known as Question 2 in Nevada, emerged victorious from yesterday’s historic election, setting us on the path to legal recreational cannabis in the silver state. So when you’re in Vegas for that bachelor party or convention next month, does that mean you can stop into a dispensary and try legal weed? Not quite yet, we’re afraid, but hopefully sooner rather than later.

The law goes into effect on January 1, 2017, at which point the private consumption and/or possession of up to one ounce of marijuana by adults 21+ will be legal. However, it will take the state’s Department of Taxation a while to catch up, draft the necessary regulations, and issue licenses for dispensaries to begin recreational sales. It’s anyone’s guess exactly how long that will take, but estimates are that it could be 6 to 9 months, which would mean that recreational sales could start in Nevada in late summer or early fall of 2017. The state’s current goal is for recreational sales to begin on July 1, 2017.

A few reminders for when recreational sales do begin:

  • You must be 21 to purchase and consume cannabis in Nevada
  • Public consumption is not permitted, and can result in a fine of up to $600
  • Employers may still enforce policies restricting marijuana use by employees

Finally, while Prop 205 for recreational cannabis failed in Arizona, marijuana passed in the other 8 states where medical or recreational was on the ballot. This wave cannot be stopped, and we know that Arizona will come back strong in 2018 (and beyond if necessary).
